Forney City Council Mar. 17, 2015 approves 2nd 7-11 w/ car-wash, rezones & annexes land

During its regular March 17, 2015 meeting, the Forney City Council -

  • Proclamation for March for Meals Month
  • Approved, as consent items:
    • An amended site plan for Rio Lerma Restaurant, located at 124 E. U.S. Highway 80.
      Mr. Regan asked about the concerns regarding visibility for parking - Mr. Morgan said the fence height should prevent issues. Mr. Hobbs wanted to verify there would be no roof - Mr. Morgan said that was true.
    • A preliminary plat for 7-Eleven South Addition, Lot 1, Block 1, located at the east corner of F.M. 741 and F.M. 548.
    • Acceptance of the public improvements for the Cedars at Gateway Apartments, Phase 1.
  • Held public hearings-
    • Regarding an Ordinance for a Conditional Use Permit for the use of "Car Wash (Self Service; Automated)" to operate as an accessory use at the east corner of F.M. 741 and F.M. 548.
      Amy Byers spoke, adressing the appearance of the 7-11, she provided council with some information and pictures of other 7-11s, and is concerned this is just a basic 7-11.
      Mayor Rozell pointed out this item was about the car wash, not the 7-11, which is allowed in this zoning.
      Alexandra Matis showed the council architectural elevation drawings, showing the project adhered to the requirements of the PD, which is all masonry.
      Mr. Stephens asked what could be done about these 10-year old PD's, and he was not in favor of this because he doesn't like being told "tough", this is the way it is.
      Mike Triantafellou, Sr. Director of Development, expressed his willingness to improve the looks of the store, as allowed by the PID. He also stated the franchisee of the current 7-11 would like to frachise this one, but it is not certain.
      Ms. Penn asked about traffic issues - Mr. Metz said 7-11 would have to submit for a TxDOT traffic analysis. There was discussion about the Kickapoo corner that was not able to get two access points.
      Mr. Parker said there was a bigger problem than just this store, the ordinances should be changed, rather than changing the rules in the middle of the game.
      Mayor Rozell reiterated this item was just for the car wash, then council voted to approve the item.
    • Regarding an Ordinance for a request for MU- Mixed Use District zoning for 57.279 acres of property out of the John Gregg Survey, Abstract No. 171, City of Forney. The property is generally located south of the intersection of U.S. Highway 80 and County Road 225. The property is under consideration for annexation into the City of Forney.
      This item was approved with stipulations.
    • Regarding an Ordinance for a request for a rezoning from AG- Agricultural District to MU- Mixed Use District. The property consists of 28.944 acres out of the John Gregg Survey, Abstract No. 171, City of Forney. The property is generally located south of the intersection of U.S. Highway 80 and County Road 225.
      This item was approved.
  • Receive Strategic Plan Report.
  • Approved an Ordinance annexing approximately 57.279 acres of land generally located south of the intersection of U.S. Highway 80 and County Road 225.
  • Approved a site plan for a 7-Eleven gasoline service station and automated car wash.
  • Approved a letter of support for a Fire Department SAFER grant.
  • Approved a Contract with the Kaufman County Election Administrator for election services for the May 9, 2015 General Election.
